Our BDSM communities could be adversely impacted by a well-intentioned, but overly broad, piece of proposed criminal legislation that has been introduced by Senator Christine Kehoe in the California Senate.  NCSF is asking all of you to sign and send to NCSF letters (a draft is attached below) that we can introduce if necessary at a hearing likely to be held in April, 2011. The purpose of the bill, SB 430, is to permit effective prosecution of strangulation or suffocation "in domestic violence, sexual assault, child abuse and elder abuse cases." But the bill's application could go far beyond those situations and result in felony prosecutions for use of hoods, gags and the like in BDSM play. There would be no requirement of "an intent to kill or injure," or of "visible injuries," and there is no mention of consent as a defense. NCSF has been in touch with Senator Kehoe's staff, which has seemed sympathetic, and has proposed modifications of the bill's language that would address our concerns.  Now we need to follow up by presenting at the hearing as many letters as possible that support the goal of prosecuting domestic violence, but only if language is inserted that protects our communities.  We urge you to sign the attached letter, modified as you see fit, and send it back to NCSF. February 13, 2008 - The American Family News Network posted an inflammatory article condemning the National Gay and Lesbian Task Force for honoring Guy Baldwin with  their Leather Leadership Award at the 20th National Conference on LGBT Equality:  Creating Change, on February 6-10, 2008 (www.thetaskforce.org). According to the February 7th article: Peter LaBarbera, executive director of Americans for Truth commented that he is  not sure if he is more surprised by one of the sponsors of the event or by one of  the activists who will be honored. "It's incredible to me," he continues. "But the Democratic Party is endorsing an event where they're actually presenting an award for sadomasochism." A sponsorship acknowledgement notes that the Democratic National Committee gave at least $2,500 to help pay for the event. The recipient of the "Leather Leadership Award" is Guy Baldwin, a psychotherapist who has successfully lobbied against treating sadomasochism as a mental health problem. Polyamory is not for everybody and it is certainly not something to be brought in to prop up a failing relationship. Unfortunately, rather than presenting this as one specific instance where polyamory might not be appropriate, Dr. Phil chose to scoff at its validity altogether: "I didn't just come in on a load of turnips. I look up everything that's out there. When I read 'polyfidelity' in the Dr. Phil dictionary, it says 'cheating'." All in all, the show should be critiqued for its dismissive stance towards polyamory and encouraged to understand that many people are able to enjoy healthy and supportive polyamorous relationships. News agencies are targeting one of the UN Weapons Inspectors to Iraq, Jack McGeorge, because he is a respected SM community leader and educator. McGeorge's professional credibility as a weapons inspector is being questioned in part because of his background as former Chairman of the National Coalition for Sexual Freedom, and as a former board member of both the Leather Leadership Conference and the educational organization, Black Rose.  
For the past three years, bar owners and clubs have faced an aggressive crackdown that has targeted SM activities. Current regulations force bar owners and hotel operators to regulate customer and employee behavior, under threat of losing their liquor licenses. Educational workshops, fantasy portions of leather contests, performance art involving flagellation, as well as casual physical contact between bar patrons are currently prohibited by ABC enforcement officers.
Privacy is an inalienable Human Right! Stand up to support the Privacy Rights of Americans! The third-highest ranking Republican in the United States Senate, Sen. Rick Santorum (R-PA), recently stated that States should have the right to proactively legislate against adult, consensual sexual relations -- particularly against adults who aren't married, monogamous heterosexuals.     It is extremely important for members of NCSF constituent communities to understand the laws that may affect us.  Overview The law is interpreted – sometimes to our favor, and sometimes not. For example, while the NCSF firmly believes that consensual SM activity between adults is legal, there are those that have a differing opinion and will intentionally interpret the law in an unfavorable way. Therefore, it is extremely important for the SM-Leather-Fetish communities to have an understanding of the laws that may affect us. Knowing relevant laws will greatly assist our communities in safely organizing and maintaining SM-Leather-Fetish activities and functions. There are numerous laws, ordinances, and regulations at all levels of government - federal, state, regional, county and city. It's not easy to locate all of the laws that may affect us, but it's very important.
