The federal child pornography charges filed against a former Bay Area
radio talk show host came about after he engaged in sex chats with an
online dominatrix from Oakdale and purportedly sent her pictures of
children engaged in sexual activity, the San Francisco Chronicle reported,
citing a police report released Friday.
The woman told police she became concerned after Bernie Ward sent her
pictures in December 2004 showing children "engaged in or simulating
sexual acts with adults or other children," Oakdale police officer
Benjamin Savage wrote in a report, the newspaper reported.
Savage could not be reached for comment Saturday.
The woman told police that she knew the man as Vincent and that he said he
was a divorced former priest from Manteca.
Oakdale police determined that the AOL account belonged to Ward and
contacted the FBI, which took over the case, according to The Chronicle.
A federal grand jury indicted Ward, a former Catholic priest, in September
on two counts of possessing and distributing child pornography using the
Internet. After the indictment was unsealed in December, KGO-AM fired him
from his job as a talk show host.
Oakdale Police Chief Marty West said the woman "was concerned about the
nature of the photographs depicting what appeared to be minors. She
readily acknowledged that she gets on sex chat lines and talks to people,
that she was just disturbed because she had met this Vincent person and
that he sent her stuff with minors being depicted."

The federal child-pornography charges filed against former radio talk show
host Bernie Ward came about after he engaged in sex chats with an online
dominatrix and allegedly sent her pictures of children engaged in sexual
activity, according to a police report released Friday.
The woman, who lives in Oakdale (Stanislaus County), became concerned
after Ward allegedly sent her pictures in December 2004 showing children
"engaged in or simulating sexual acts with adults or other children,"
Oakdale police Officer Benjamin Savage wrote in a report.
An America Online chat-room user by the name of Vincentlio engaged in
sexually explicit chats with the woman in December 2004 and January 2005,
Savage wrote. Vincentlio addressed the woman – whose screen name was
Sexfairy2005 – as "mistress," while she addressed him as "slave," the
report said.
Vincent discussed engaging in group sex at a San Mateo porn theater and
wrote at one point, "I love trading pictures," the police report said.
"And why haven't I gotten any pics, slave?" Sexfairy2005 responded,
according to the report. "Send me some."
Vincent sent her a photo of a naked boy sitting on a chair between a
topless woman and a clothed girl, the police report said. Vincent told the
woman that the boy was 14 years old, the girl was 12 and the woman was in
her late 30s.
His attorney, Doron Weinberg, said the conversations Ward had with the
woman consisted only of role playing as part of a book he was researching
on hypocrisy.
"There are a lot of things in there that seem pretty outlandish, but
they're completely fabricated, just absolutely fabricated," Weinberg said.
"They have no truth. He thought he was role playing."
Weinberg said his client did, however, transfer an image to the woman, a
picture that "she solicited." He disputed investigators' assertions that
Ward had sent several explicit pictures to the woman. Oakdale police said
the photos showed children of both sexes ages 4 to 17, but did not provide
specifics.
Ward's business attorney, Jeannette Boudreau, said "the authorities have
been in possession of the messages for three years. Bernie was only just
indicted in December. There is no doubt in my mind that they would not
have allowed Bernie to conduct his family and work life as usual for all
that time if they believed the content of the messages to be factual."

"Of course I will," I responded excitedly to the scantily-clad seductress
tightly gripping a long, leather whip. Why wouldn't I be? I was at my

I'll admit I was slightly apprehensive about attending the event due to
the fact that I have very limited experience with what I naively thought a
fetish ball consisted of: BDSM (i.e., bondage and discipline, domination
and submission and sadomasochism).
But fetishism is not just about BDSM although pain is pleasure for some of
the attendees I met. There are an infinite number of fetishes depending on
the individual person's taste.
Not all people who have a fetish are creepy pervs and, in fact, probably a
few people you know or even you maybe have one.
Got a thing for handcuffs or blindfolds? Or perhaps role playing as
student and teacher gets you hot and bothered? Join the club. We've all
got sexual fantasies we're dying to play out and most of them consist of a
fetish of sorts. So strip off your clothes – and negative stereotypes.

Scanner's Sex Boycott for New York Post Readers

As we reported yesterday, The New York Post revealed the identity of a man
who happened to choke while minding his own business at a BDSM club. The
Post ran a series of stories about the man, his family and his profession
and called his presence at the club his "shameful habit". When questioned
about the ethics of revealing the man's name, a spokesperson for the paper
shamelessly declared "The Post will happily name every adult caught in a
dog collar".
We've never been big fans of The Post and its yellow journalism. This
particular incident has sent us over the edge. We thought about calling
for a boycott of The Post, but that wouldn't do much good. What would we
do? Keep not buying The Post? Plus, we're going to go out on a limb and
guess that a fair number of the people who get their news from The Post
think it's probably okay to out someone like that. So, instead we're
calling for a boycott of sex with people who read The New York Post.
That's right. If you believe that what The Post did was wrong, and you're
sleeping with someone who reads that paper, or considering sleeping with
someone who reads that paper, don't do it. We're all for sex, but we're
also all for people having the right to practice whatever sexual fetishes
they want to do freely (as long as they're not hurting anyone else, which
this man clearly was not) without having their names and faces splashed on
the front page of a New York City tabloid.
How long will a Post reader go without nookie before s/he finally makes
the switch? And what kind of effect could this have on The Post's sales?
We know it's already hurting for readership, that's why they shove free
copies in everyone's faces. What would a sex boycott do to The Post?

County Offers Couple $15,000 to End Suit Over Bondage Site

Kitsap County this week offered a Kingston couple $15,000 to end a federal
lawsuit the pair brought against the county and North Kitsap School
District claiming civil rights violations after they were charged in a
case stemming from allegations that they operated a bondage Web site near
a school.
Robert Apgood, attorney for Jeffrey and Susan Marie Owen, said he had
received the offer, but he declined to comment further.
The $15,000 offer only accounts for the county officials' involvement.
Attorneys for the school district and the superintendent filed a motion
Thursday in U.S. District Court in Tacoma to dismiss the case against
them, claiming Superintendent Gene Medina merely reported the allegation
to police and was not part of any decision to prosecute the couple.
"Because he was not involved in these decisions and because he has a right
to report suspected criminal activity, neither he nor the District can be
held liable for any of the alleged Constitutional violations claimed by
the Plaintiffs," according to the filing.
In August 2005, the Owens were charged in Kitsap County District Court
with a misdemeanor in relation to the alleged "sexual encounter center"
they operated without a license at their West Kingston Road home, which is
within 1,000 feet of a school. Photographs of scenes of bondage were taken
at their property for their Web site.
The charge was dismissed for lack of evidence in January 2006. A little
over a year later, the couple sued Kitsap County, Sheriff Steve Boyer,
Sheriff's Lt. Earl Smith, Prosecutor Russ Hauge, Deputy Prosecutor Jeffrey
Jahns, the North Kitsap School District and Medina, alleging that their
constitutional rights were violated and that they were "maliciously
prosecuted" without probable cause. They also said that items were
wrongfully seized from their home.
The Owens contend in court documents that their home was not the site of a
business and that it was not a "sexual encounter center," but an
occasional, private location used to film content for a Web site.

Man Spends Three Days in a Coma After Kinky Sex – but Unsafe Play Can
Result in Death

A Canadian college professor spent three days in a coma over the weekend
after losing consciousness in a New York sex club where he was left alone
with a dog collar around his neck and a leather hood over his face,
according to a report in the New York Post.
The man, identified by the Post as Robert Benjamin, 67, was found passed
out last Friday by a dominatrix in a sadomasochism club called the
Nutcracker Suite. The dominatrix noticed that his foot had turned blue
after the high-heeled shoe he was wearing fell off, according to the
exclusive report in the Post.
Law enforcement sources told the Post that Benjamin, whose fetish was to
be bound in S&M gear and then left alone, lost consciousness when the
oxygen flow to his brain was cut off while he was hanging from his arms.
Benjamin was rushed to Manhattan's St. Vincent's Hospital early that
morning and regained consciousness Monday, promising to come clean to his
wife and never engage in dangerous sex again, the Post reported.
Compared to a series of recent incidents in which practitioners of
dangerous sex died to satisfy their kink, Benjamin, who was reportedly a
regular at the club, was lucky.
Sadomasochism encompasses a broad swath of sexual interests, but always
involves a certain degree of giving or receiving pain in the interest in
sexual gratification. In some cases, it can be deadly.
Last October, a medical examiner determined that the Rev. Gary Aldridge, a
51-year-old Baptist minister from Alabama, died from accidental
asphyxiation while pleasuring himself. He was found wearing two wet suits,
a face mask, diving gloves, slippers, rubberized underwear, two ties, five
belts and eleven straps, according to the medical examiner's report.
In April 2006, British national Adrian Exley suffocated to death in the
closet of a Rhode Island man whom he had met online. Exley was wrapped
tightly in heavy plastic and bound with duct tape, and a leather hood was
over his head. Gary LeBlanc, the man who tied Exley up, in a sex act both
men had consented to, later committed suicide, according to The Associated
Press.
The "Janus Report on Sexual Behavior," one of the premiere academic
surveys of sex practices, found in 1993 that 14 percent of men and 11
percent of women have had some sexual experience with sadomasochism.
But sadomasochism is difficult to define. Some practitioners engaging in
highly dramatized "play" that has more to do with theater than pain, while
others look to be severely tortured, said Martin Weinberg, a sociologist
at Indiana University who has studied sadomasochism clubs.
"There are two forms of SM. One is a sociological phenomenon and is more
about socializing with other people. People go to a club for recreational,
theatrical fun. The other is a psychological phenomenon. Something in
someone's biography leads them to seek out SM," he said.
Some forms of sadomasochism and the related fetish of bondage sex have
gained a certain degree of normalcy. Clubs have sprung up across the
country along with shops catering to fetishists in most major cities.
Every year in San Francisco, some 400,000 people attend the Folsom Street
Fair, an outdoor festival dedicated to the safer and more commercial
aspect of sadomasochism, according to the event's Web site.
"There are multiple organizations across the U.S. and internationally that
educate people about safe play and kinky sex," said Vincent Andrews,
president of the National Leather Association, a network of S&M community
organizations.
"Almost every major city in the U.S. has a BDSM (bondage-sadomasochism)
event geared towards safe play," he said.
But for some, "safe play" is the opposite of what they're looking for.

Paying for erotic favors is okay, as long as your tastes are generic.
That, in a nutshell, is the sexual ethic of the New York Post.
How else do you explain a paper where the top editors hang out at strip
clubs at night and spend their days shaming fetish-club patrons by name?
I refer to coverage of the 67-year-old man who had to be hospitalized
after an accident at the hands of a dominatrix in a Manhattan
establishment called the Nutcracker Suite. Today, the Post crossed into
ethically murky territory with a story that named the man (citing
"law-enforcement sources"), and described his professional history,
hometown and family situation. For good measure, the Post's reporters also
took it upon themselves to phone the man's wife and fill her in on the
details.
Since the man is not a celebrity, politician or other public figure, it's
hard to understand what kind of news value the Post's editors saw in
printing his name, or what they accomplished beyond embarrassing him in
front of his community and ensuring that the episode will forever be his
top Google hit.
I tried to ask metro editor Michelle Gotthelf how she justified the
decision, but she referred me to the paper's spokesman, Howard Rubenstein,
who offered this statement: "The Post will happily name every adult caught
in a dog collar."
But that flip answer hardly does justice to the very serious privacy
concerns raised by the Post's reporting. "He's not being charged with
anything, so why is his personal information being broadcast in this way?"
wonders Susan Wright, founder and spokesperson for the National Coalition
for Sexual Freedom, a group that defends the right to legal forms of
"alternative sexual expression" such as BDSM. "It seems to me he is a
victim. This is why people don't use their real names." (The man in the
Post's story was carrying no identification at the time of his
hospitalization.)
Dan Savage, the syndicated sex-advice columnist and editor in chief of
alt-weekly The Stranger, agrees. "No crime was committed. What the house
of domination does is legal, patronizing it is legal. Without criminal
charges, where's the newsworthiness? It's just an attempt to trot out some
salacious details about kinky sex to move some newspapers."
Is it even, though? Or does the contempt expressed in Rubenstein's
sneering quote have more to do with it? After all, it's the details of the
story that are the juicy part; it's hard to imagine anyone shelling out
even a quarter merely to read the name of a non-famous, middle-aged
retiree.
It's also bad business, given that the Post serves one of the most
sexually liberal cities on earth. "What annoys me is this attitude that
nobody who reads the Post is kinky and nobody who works at the Post is
kinky," says Savage. "It's completely cruel and unnecessary, and you would
think that someone in that newsroom would have had a 'there but for the
grace of God go I' moment.

The kinky college professor who was almost strangled during an S&M session
at a Midtown club told The Post yesterday he's deeply ashamed and is
finally through with the double life he's lived since he was kid.
"I don't want this to spoil my marriage," said Robert Benjamin, 67, still
disoriented from the three days he spent in a coma but sitting upright in
a chair in his room at St. Vincent's Hospital.
"I don't want my wife to leave me, but I have to tell her the truth," he
said. "I'm going to share everything with her. I think my family will
forgive me,"
Benjamin said he's desperately trying to break his addiction.
"It's like when you crave a turkey," he said. "You eat it and you eat it
and you eat it, but you still want it. But now I've had enough. I don't
want turkey anymore. I'm full."
His life was saved last Friday by a dominatrix at the Nutcracker Suite on
East 33rd Street, who was assigned to check on him after her colleague
left him with a dog collar around his neck and a leather mask over his
face, suspended a few inches off the floor.
She realized his foot was turning blue because one of his high heels had
slipped off.
"I don't want to go to the clubs anymore," Benjamin said.
"I'm trying to learn to control myself and my emotions. I've seen doctors
to help me," he said, adding that he's been unable to control his desires
"from very early on in my life."
Benjamin managed to keep his shameful secret from his wife, his two kids,
who are now adults, and the students he taught at Montreal's Vanier
College until his recent retirement.

A retired math teacher from Quebec survived near-fatal sex play at a
midtown bondage club but couldn't tell investigators how he was injured,
law enforcement sources said Monday.
The 64-year-old thrill-seeker had been found turning blue, hanging in a
dungeon room at the Nutcracker Suite on E. 33rd St. Friday morning.
Dressed in a dog collar and a pair of women's high heel shoes, the victim
had paid staff at the upscale S&M club $100 an hour to check on him every
hour.
"He comes down to visit once in a while," his unsuspecting wife said when
reached in Quebec.
The Daily News is withholding the victim's name.
She said she had been told her husband had been found "unconscious on one
of the streets."
She described her husband as a retired math teacher who didn't drink or go
to nightclubs.
"I thought New York was safe," she said.
The retiree was discovered by club staff about 1:30 a.m. and taken to St.
Vincent's Hospital Manhattan.
Doctors removed the breathing tube Monday, but the victim said he didn't
remember anything, sources said.
Police were investigating whether club employees could face negligence
charges.

The kinky clubgoer who almost choked to death at a Midtown masochism mecca
is a married, retired math professor from Montreal, The Post has learned.
Richard Benjamin, 67, who was rushed unconscious to St. Vincent's
Hospital, awoke from his ordeal yesterday and identified himself to cops,
law-enforcement sources said.
Benjamin, who had been on a respirator, is married and has children.
He retired three years ago after teaching for 30 years at Vanier College,
a two-year junior college in the Ville St. Laurent section of Montreal,
said the school's math-department coordinator, Fred Mayer.
His wife, who declined to give her first name, said, "I thank God that my
husband is still alive."
She asked a reporter to tell her the full story, and when it was finished,
she said, "Oh, my gosh, I can't believe this."
Benjamin was taken to the hospital at 1:25 a.m. Friday after he choked and
turned blue while wearing a hood and being trussed up in an S&M
contraption called "the wheel" at the Nutcracker Suite, a pain palace on
East 33rd Street.
The ex-prof, whose hands were bound behind him, had a leather collar
around his neck that was attached to a rope secured to a hook on the
ceiling.
He was wearing nipple clamps, and his feet were in women's high heels.
Cops said Benjamin began choking when one of his feet slipped out of the
tall shoe.
The club's manager, Clifford Weiss, called 911.
In keeping with the secretive nature of the S&M world, Benjamin was
carrying only his MetroCard, and no ID, when he signed in at the club's
guest registry as "Roger."
Sources said he was a regular.
They said Benjamin's particular fetish was to have himself trussed up and
left alone.
Mayer said he only knew his former co-worker as a well-respected and
well-liked teacher.
"He was very sensitive to the needs of students, and that made him
popular," Mayer told The Post. "He always made them work. I think they
appreciated that."
The dominatrix with whom Benjamin was working, Taki Noriko, 30, of
Williamsburg, said that she elevated him just enough to cause discomfort
but that his feet were still in the shoes.
She said she checked on him every 20 minutes. The first time he was OK.
The second time, one of his feet had slipped out of the shoe and he was
turning blue, she said.

National Coalition for Sexual Freedom (NCSF) is a national organization
committed to altering the political, legal, and social environment in the
U.S. in order to guarantee equal rights for consenting adults who practice
forms of alternative sexual expression. NCSF is primarily focused on the
rights of consenting adults in the SM-leather-fetish, swing, and polyamory
communities, who often face discrimination because of their sexual
expression.
