Greenburgh cop disciplined in dominatrix case gets promotion

GREENBURGH – Two Greenburgh police officers have been promoted to
sergeant, one of whom was disciplined this year for his treatment of a
dominatrix in police custody.
Edward Olson was among several officers who "acted sophomoric and got in a
little trouble" for their treatment of Gina Pane, a dominatrix who was
arrested last year on drug charges, Police Chief John Kapica said.
But Kapica said Olson scored the highest on the sergeant's exam and has
been a leader in the department's street crime unit. The chief said he was
satisfied that the promotions board made a good choice and that Olson
would make a good sergeant.
"Ed Olson had some issues, yeah, but I think he's gotten through them," he
said. "If I didn't think Ed was good for the job, I wouldn't have
recommended him."
Olson, a Greenburgh police officer since 1999, was disciplined for his
behavior but was not suspended, Kapica said. He would not discuss the
details, citing employee confidentiality.
Pane is suing the police department for $5 million to compensate her for
pain and suffering she said she endured after her arrest on drug charges.
Kapica, former police Officer Erik Ward and several "John Does" are named
in the suit. Olson is not named.
Pane, a Manhattanville College graduate, claims officers harassed her at
headquarters following her arrest in January 2006 when they learned of her
occupation.
Pane later accused Ward of demanding kinky sexual acts after he asked her
to be a confidential informant, an accusation Ward has flatly denied.

Judge orders stop to adult activities at Weirton mansion

NEW CUMBERLAND – Circuit Judge Arthur Recht took a while to figure out how
to apply zoning law to a kinky Web site, but at last he caught on.
Recht signed an injunction July 10 to prevent activities that Rosemary
Susko advertised at Rosemont Manor, a mansion in Weirton.
He listed them: "BDSM, fetish, master/slave, lesbian/gay trans-gender,
fem-dom, leather, swingers, nudists, CFNM, barbeques, munches, parties,
meet-and-greets, play space, lectures, seminars, demonstrations, schools
…"
He wrote that any Web site inviting attention to those activities would be
"removed forthwith and shall not appear on the internet again unless
authorized by this court."
Susko scored a partial victory. Recht ordered Weirton to issue a license
for Rosemont Manor.
The city revoked the license last year due to Web site content. On the
web, Susko called the place Our House on the Hill.
Recht stressed in his order that the license would cover only a bed and
breakfast with weddings and receptions.
"Is it permissible to deny a business license and a zoning application
simply based upon a Web site with no other proof that what is recited in
the Web site actually occurred?" he asked. "I don't know anything about
Web sites. I have a computer and it's all prepared for me by other people
and I push buttons and it works."
For the city, John Yeager Jr. of Weirton said Susko did not deny the
activities at a zoning hearing. He said Susko could obtain a license for a
sexually oriented business.
"But not in that zone," he said. "That's a residential zone.
Yeager said Susko essentially asked to continue to break zoning laws.
"I also worry that she will say, if she is not sponsoring this but simply
rents to people who do it, then she's not responsible," Yeager said.
Recht said he contemplated an order reserving to Susko the right to use
the property as it was grandfathered, and no activity as described on
websites could be conducted until further order.
Yeager persisted: "Shall the Web sites come down, your honor?"
Recht said, "Yes. Is that how you do it? Is that what you say?"
Yeager said, "It's up to them to do it."
Recht got frustrated.
"No, is that the language you use?" he asked. "Is that how you eliminate
them? God damn."
"This cyber stuff, I don't understand it," Recht said. "You push a button
and it comes off?"
Yeager said, "I couldn't even set up a joint phone call."
Recht said, "The Web site shall be removed, taken down, eliminated. I
don't know what verb to use.
"If there's anybody in this audience that understands this cyber business,
tell me. I'll appoint you as an expert witness to assist me. I can't pay
you but …"
Ryan objected. He said no Web site was relevant to any zoning law.

Police say S&M bondage session ended in killing

Police have arrested a San Francisco man on murder charges stemming from
what authorities believe was a sadomasochistic bondage session that ended
in the victim's death.
Terry D. Frazier, 40, was arrested Wednesday in the July 11 death of
former community activist Joe Konopka, 65.
Police found Konopka's body at his home on the 500 block of Ashbury Street
in the Upper Haight after someone called authorities from the address. He
was bound with handcuffs and his face was covered with plastic.
Frazier was arrested at Sixth and Market streets on suspicion of murder,
robbery, burglary and false imprisonment. He was also being held on an
unrelated warrant for drug charges.
According to sources familiar with the case, investigators believe that
Frazier bound Konopka with handcuffs during a bondage session and disabled
an automatic release mechanism. As Konopka choked on the plastic, Frazier
took his laptop computer, jewelry and cell phone, police believe.

Was Man Beaten by Cops for Assaulting His Girlfriend?

A 40-year-old man beaten by sheriff's deputies and Portland Police Bureau
officers at the Multnomah County Detention Center last September may have
been the recipient of some rough "justice," having just been arrested for
assaulting his girlfriend with a riding crop.
Video of the incident, obtained by the Mercury and posted on
blogtown.portlandmercury.com last week, shows Michael Evans being beaten
in the booking area of the jail on SW 3rd – apparently without provocation
– by Sheriff's Deputy Richard Hathaway. In the video, six sheriff's
deputies and Portland Police Bureau officers get involved after Hathaway
kicks, then punches Evans four times, bringing him to the ground.
In a report on the September 11 incident, Hathaway wrote that he
controlled Evans using two "focused blows" with his right closed fist,
after Evans "struck me in the nose during booking." Evans' alleged
striking of the deputy is not apparent from the video. Greenwald's letter
to the city contends that Evans did not receive medical attention for 18
hours after the assault, that he used his own shirt as a towel to soak up
blood and apply pressure to his broken bleeding nose, and that he reset
his own nose.
It is… possible Evans was treated roughly because of the nature of his
crime – he was eventually convicted for assaulting his then-girlfriend.
Evans was arrested by police at a house in Southeast the evening of
September 10, after police were called by neighbors who reported "a female
crying, and saying, 'I'm sorry, I'm sorry, don't hit me again,'" according
to court records. The woman, Kelley Gallaway, "told the officer that she
was hit by the defendant in the hands and legs with a riding crop," the
records continue. Gallaway had multiple bruises, including red marks fresh
from the incident. She also told the officer that Evans had threatened her
with a gun two weeks earlier.
Evans' defense attorney, Gareld Gedrose, argued at his trial that Evans
and Gallaway had been involved in a consensual BDSM relationship in which
Evans played the "dominant" or "dom" and Gallaway played the role of the
"subservient" or "sub." "This relationship also involved Gallaway being
'punished' by being struck with a riding crop," Gedrose argued.
"I'm not sure if the sheriff's deputies knew of the circumstances of
Evans' arrest," says Theresa "Darklady" Reed, a BDSM expert who testified
for the defense at Evans' trial. "But if so, that may have impacted their
behavior. Peace officers are people too, and most people feel very
protective of women."

A man with a "passion for family" was arrested at an airport on charges of
planning to meet a Colorado mother and her 11-year-old daughter for
sadomasochistic sex and was ordered held without bail Tuesday as a danger
to the community.
Paul Hinkley, 69, had used his credit card to reserve a hotel room at the
airport for four nights to have sex with the mother and her daughter and
had told them to expect bondage and discipline, prosecutors said. In the
car he drove to the airport, federal agents found rope, an enema bottle,
condoms and Viagra, they said.
The Manhattan man was arrested Monday at Newark (N.J.) Liberty
International Airport on charges that carry a potential mandatory minimum
penalty of 30 years in prison and a maximum of life. He had showed up at
the airport expecting to meet the mother and daughter, Assistant U.S.
Attorney David A. O'Neil said.
But Hinkley, using the screen name saltyoldsailor200269, actually had been
speaking on the Internet from January through July with an undercover
officer in the Canon City Police Department in Canon City, Colo.,
prosecutors said in a release.
He was charged with crossing state lines intending to engage in sexual
activities with an underage girl. He also was charged with using the
Internet to attempt to entice a minor to engage in sexual activities and
with traveling in interstate commerce for sex with a minor.

Slave Contract Ends With Pair In Handcuffs

PORT RICHEY – She calls him "master." He calls her "slave" or "Jessica,"
the name he chose for her.
Alyssandra "Aly" Cardillo said she was looking to serve a man. He was
looking for a mistress.
Their paths crossed on a bondage, discipline and sadomasochism Web site.
Weeks later, the 19-year-old packed her bags and took a cab from Silver
Springs to Drew Kobak's home in Pasco County.
They had sex right away, she said. By Monday, Cardillo had signed "Master
Drew's Slavery Contract," pledging housekeeping services, her body and her
life to him for five years.
It didn't last five days.
On Tuesday, detectives from the Pasco County Sheriff's Office Vice and
Narcotics Unit arrested Kobak, 34, and Cardillo on prostitution-related
charges, effectively voiding the contract.
The illegal part wasn't necessarily the slave-master relationship,
authorities said. It was the men who answered an online ad offering
after-work massages and reportedly ended up sexually satisfied.
Andrew Michael Kobak, of 7601 Jasmine Blvd., faces charges of deriving
proceeds from prostitution, maintaining a place for prostitution,
cultivating marijuana and marijuana possession after deputies reported
finding the plant growing in his backyard. He was released from the Land
O'Lakes jail early Wednesday after posting $15,150 bail.
Cardillo was issued a notice to appear in court on a misdemeanor charge of
prostitution.
She doesn't want to return to Silver Springs, and authorities have told
her to stay at a domestic violence shelter, she said by cell phone.
Cardillo said she's afraid, confused and upset about the prostitution
charge but plans to stay in the S&M world.
"I don't understand why that lifestyle is wrong," she said.
Cardillo said she willingly signed a 10-page contract in which she
promised to do anything he wanted, sexually and otherwise. She would be
permitted to sleep about four hours a night. The other 20 hours would be
devoted to cooking, doing laundry and pleasing "Master Drew."
"My control over your life shall be unhampered and without limit," the
contract stated. It dictated what she could wear – which often included a
dog collar – how she would behave and how she would be punished if she
disobeyed or disrespected her master.
Weekly "special training" would include: "Owner's complete control in her
use of humiliation, surprise discipline, cage/bondage time, gags, hoods,
etc., cleaning, servant feeding, retraining. . Owner will prepare progress
reports on the training of the slave as she desires," the contract said.
A copy was found in Kobak's house among S&M items such as chains and
whips, sheriff's office spokesman Kevin Doll said. Kobak, however, didn't
sign the contract.
Cardillo signed, stating she fully understood it and promised to fulfill
her obligations.
