“We had a complaining witness come to the planning department. We then investigated from their own website, a lot of their own rules indicated that what we believe is an adult’s only establishment,” Kanawha County Deputy attorney Christopher Settles said. “They’re regulated by our ordinance and given the setbacks, they’re not in a location that can operate there.” However, people representing the company said it is not a business, it is a private social club, which is why they feel the ordinance has been inappropriately applied to the company.
